These Terms of Use govern access to and use of the SOM/TFF Institute governance diagnostic platform. By accepting, the authorized user agrees to the following conditions on behalf of the licensed organization.
1. License and Access
Access to the Platform is granted exclusively under a valid SOM/TFF Institute license agreement. Access is non-transferable, non-sublicensable, and limited to the organization and individuals identified in the license record. Any access attempt outside the scope of a valid license is unauthorized and will be terminated.
2. Confidentiality of Assessment Data
All data submitted through the Platform, including questionnaire responses, scores, diagnostic outputs, and generated reports, is confidential. Users may not share, publish, or disclose assessment data to any party outside the licensed organization without prior written authorization from SOM/TFF Institute. Assessment outputs are produced for internal governance use only.
3. Methodology and Intellectual Property
The SOM/TFF diagnostic methodology, including the Triune Law framework, tool architecture, scoring logic, and all associated instruments, is the exclusive intellectual property of SOM/TFF Institute. Users may not reproduce, reverse-engineer, adapt, teach, license, or redistribute any component of the methodology in any form. Use of SOM/TFF vocabulary, frameworks, or outputs as a basis for derivative works is prohibited without a signed custodial agreement.
4. AI Processing Disclosure
This Platform routes certain inputs through the Anthropic API for AI-assisted analysis. Data submitted for AI analysis is processed under Anthropic's zero-retention policy. SOM/TFF Institute does not authorize Anthropic to use submitted data for model training. No personally identifiable information should be entered into AI analysis fields. By using AI-enabled features, the User acknowledges and accepts this processing arrangement.
5. Data Recovery and Access
Assessment data is stored within the Platform for the duration of the active license period. SOM/TFF Institute does not guarantee indefinite data retention beyond license expiration. Users are responsible for exporting and retaining copies of all reports and outputs required for their records. SOM/TFF Institute is not liable for data loss resulting from license expiration, user error, or system events outside its reasonable control.
6. Limitation of Liability
The Platform and its outputs are diagnostic instruments, not professional advice. SOM/TFF Institute provides no warranty that diagnostic outputs will produce specific organizational outcomes. To the maximum extent permitted by applicable law, SOM/TFF Institute's liability for any claim arising from Platform use is limited to the license fees paid in the twelve months preceding the claim. SOM/TFF Institute is not liable for indirect, incidental, consequential, or punitive damages of any kind.
